Terms and Conditions of Delivery and Payment

  1. Scope

Unless otherwise agreed in writing, these General Terms and Conditions of Delivery and Payment apply to all deliveries of products and goods from Dirndl Haus Manuela Freistetter, which are made on the basis of orders from consumers/end customers (within the meaning of the Consumer Protection Act) via distance selling.

If there are still any ambiguities in the interpretation of the contract, these must be resolved in such a way that the content that is usually agreed in comparable cases is deemed to have been agreed.

Attention! These terms and conditions become part of the contract when you submit your order.

  1. Conclusion of contract

Our offers are entirely non-binding. A contract is concluded when you submit your order and we confirm the order or deliver the goods.

The automatically sent order confirmation is for your information and control purposes and does not constitute an order confirmation.

Any deviations from your order must be reported in writing immediately after receipt of the confirmation.

We are entitled not to accept orders or to accept them only in part. If we reject the order or parts of the order, we will notify you immediately.

 3. Price

All prices quoted by us are in € (Euro) and, unless expressly stated otherwise, include VAT, excluding delivery costs and any additional services.

For online orders, the prices stated on the Internet apply. By placing your order, you accept the prices and shipping costs immediately stated .

  1. Terms of payment, reminder fees

The customer/buyer undertakes to pay the full price and shipping costs upon conclusion of the contract. Payment is made in advance or via Paypal

You will be responsible for reminder, debt collection and out-of-court legal costs. The reminder costs currently amount to 30.00 EURO.

 
  1. Right of withdrawal/right of return

Consumers can withdraw from a contract/contractual declaration concluded via distance selling within a period of 14 days. The withdrawal period begins upon receipt of the delivery of the ordered goods. For consumer customers from Germany, we grant a statutory right of return of 14 days from receipt of the delivery. It is sufficient if the declaration of withdrawal is sent within the period without stating reasons.

In the event of withdrawal, a full or partial refund of the purchase price will only be made in return for the return of the goods received by the customer.

The costs and risks of return are borne by the customer.

The goods must be returned in an unused and re-saleable condition and in the original packaging. For items that show signs of wear or whose packaging is damaged, we will charge an appropriate fee for the reduction in value. The same applies if accessories or parts are missing when the goods are returned or if the return is carriage forward.

 
  1. Shipping costs

Our sales prices do not include the costs for shipping/delivery. We provide this service for a separate fee. The costs incurred are automatically calculated and announced during the ordering process.

  1. Delivery period

We deliver as quickly as possible via parcel service (DPD). We usually ship immediately after receipt of payment, at the latest the next day. We reserve the right to change the transport company. Please note that the delivery time depends on the transport company and we have no influence on this and therefore cannot guarantee the delivery date.

Please be sure to provide your telephone number when ordering; this is necessary for delivery.

  1. Transport damage, complaints

The goods must be inspected immediately after delivery. Any defects found must be reported to the seller immediately, but no later than within 3 days of delivery, stating the type and extent of the defect. Hidden defects must be reported immediately after they are discovered. Obvious damage/defects should be noted on the delivery note; only then can we guarantee you a free replacement.

  1. Damages, product liability

Claims for damages in cases of slight negligence are excluded. This does not apply to personal injuries or damage to items taken in for processing. Any claims for recourse made against us by contractual partners or third parties on the basis of “product liability” within the meaning of the Product Liability Act are excluded unless the party entitled to recourse proves that the error was caused in our sphere of influence and was at least due to gross negligence.

  1. Retention of title

The goods remain our property until full payment has been made. Resale is not permitted.

  1. Place of performance, choice of law

The place of performance is the registered office of our company: Gute Sorte Trading GmbH

 Austrian law applies. The applicability of the UN Convention on Contracts for the International Sale of Goods is excluded. The contract language is German.

  1. Data protection/storage of the contract text

We save your address and order-related data (name, first name, street, house number, postcode, city, email address and telephone number) in order to process and execute your order. We are committed to comprehensive protection of your personal data in accordance with the provisions of the Data Protection Act. This data is not passed on or sold to third parties, but is only used by the logistics service providers commissioned by us and for our own marketing purposes.

Each order is saved and can only be accessed again by registered customers after completion. However, it is possible to print out the order data immediately after placing the order.
